Gonna make some enquiries tomorrow with the Building Society and their legal buffs.

Ta for the advice..

LW, my niece (lawyer) just informed me that you should take pictures of the existing fence so you have evidence of the existing marker. In case there isn't any boundary makers, adjudication can be based on the existing markers

I'll do that then, ta.
Even looking at Google Earth last night although its not a definitive judgement its a damn good indication and it seems clear where the boundary lies. The builder turned up just before 8am this morning and I updated him with yesterday's developments. He didnt seem phased by it at all, he said he gets this all the time. He's chopped off the 8" which was in dispute. Even he agrees that the building line is where I thought it was...... just come back from walking the dogs and the neighbour has been out, he apologised for the fuss to the builder, almost in tears apparantly. It seems this complication is down to the elderly neighbours Son who clearly dictates to his Father what is and is not going to happen. His Son does'nt even live there.  ::)

I'd love to be able to offer advice on this one...but i am not versed in legal stuff...so the only thing i could manage is standing at the bottom of your garden and looking scary!! :o

Hope you get this sorted  ;D
It's not a case of whether we can fix it or not - it's more a case of how fixed would you like it?

Kwikasfuki

The son's probably going to inherit it. LW, stand your ground. If that is the boundary, get it confirmed so you don't have issues later on.

The son sounds like a twat.

I've had a chat today with our Building Society, the Land Registery, a firm of Surveyors and finally a legal firm linked to a policy I have connected to my mortgage. Its some sort of legal assistance for neighbour disputes. They are going to send me out a questionaire which they said will probably take me two to three days to complete, I dont like the sound of that already. Then they will forward the document to their underwriters who will make a decision whether it is viable for them to take it on.

Rusty

Careful Mr Wolf ... these disputes can get very nasty ... and expensive !

Yeah I know, but its the principle of the matter and pride comes into it too.

I'm working from the neighbours top garden post in a straight line down his drive and in my book unless the building plots were all created with drives with dog legs in them, then the bit at the bottom of my garden is my land. He's doing alright out of it though, he's nicked nearly three foot x 30 at the bottom of my garden and then he's nicked a similiar width half the length of his drive which belongs to the house adjoining me.  >:(

Looking at the picture (and trust me here I am certainly no legal expert) I can only say is this guy a total knob jockey.

Lonewolf

Yes he is & his Son is an even bigger one!

Kwikasfuki

From the pic it looks like you're in the right. What about the rest of the gardens on your street. How are they divided?

Many of the houses are of an individual design, but regardless of that everyone's drives at our end of the street are parallel to each other and straight.

Speaking to my legal team and showing her the picture. Psycho man next door is on a sticky wicket what should happen is the any one else who has had land taken by him should partner up with you and take him to court. Aternativly the advise was F**K him build the wall anyway and let him take you to court.

Lonewolf

It doesnt directly involve the woman who lives in the house adjoinging me. She knows that on the far side of her garage is a small area which belongs to her but there's nothing she needs it for so she is happy to leave things as they are. My issue is that a wall is kind of permanant and I only intend to put it up once! In the right place!!  >:(

I appreciate the Son is only looking out for his Father, thats fair enough but all I want to do is build my wall on my land.
