A few weeks ago a lass who I work with turned across the path of a chap and his wife on there 5 day old  Triumph tiger the crash that followed put him in an ambulance and his wife in the air ambulance. My colleague has been charged with driving without due care and attention, and will be pleading guilty. As you can imagine she says she never even saw the bike. What kind of fine do we think she will face?.                               Good result on the condition of the two on the bike, the lady was fine after a few days in hospital, and her husband who took a severe wack in the pods  are both on the mend, with no bones broken. Unfortunately the same cannot be said about the bike.

Geoff, there are those on here who may have a better idea about the forthcoming sentence of your colleague.....although it must be said that on many an occasion drivers causing accidents to bikers seem to get away lightly

The courts have a power to impose a discretionary disqualification for due care, I have known this to occur on occasions where there were aggravating factors. Serious injuries, extensive damage to personal property etc.
More usually, I think up to 8 points and a hefty fine of a few hundred £'s. Thats the norm at our Courts anyway but things may be different out in the wilds of Leyburn.
The guilty plea will help.

Rusty

+1 with Mr Wolf ... an early guilty plea is always good for the defendant ( your friend ) .. the fact that there are no aggravating circumstances in that she has a clean license, the car is insured and it  had no mechanical defects.
Then of course the 2 injured parties are making a good recovery,.... she is very very sorry.... and has put her hands up at the earliest opportunity.
Turn up at court in plenty of time, look smart, find the correct court, TAKE HER DRIVING LICENCE WITH HER and ask that she may pay the fine over a period of time as a lump sum would cause financial hardship.
An error of judgement and there by the grace of god go us all.
£5 - £600 fine and 6 - 8 points.
( I Should go to Uni and become a barrister ! )
Hope she is ok.

Lonewolf

Rusty, I've never known anyone just get a £5 fine for due care. Maybe when you first joined, (you are a lot older than me) but these days its nearer the other end of your scale.  :whistling:

Rusty

It's meant to read as "Five to six hundred pounds" .... Bloody Northerners !!!  :mfr_lol: :mfr_lol:
There are still by laws relating to "Wanton and furious riding of a Carriage" .... they still use that over near Chichester to stop the local friendly travelling community from racing along the A27 to Tapps' area of abode !!!

Lonewolf

And its still an offence for a Hackney Carriage not to carry a bale of hay for the horse, even though there is no horse!  Strange but true.

Rusty

We are definitely going off topic here but there must be a job for you at the Cab Enforcement Office  :mfr_lol: :mfr_lol: ... now ... back to that court case

Lonewolf

Yes, back to the matter in hand. Hopefully Geoff's friend from work will be ok and not penalised too harshly. Anybody can make a mistake.

Update on my colleague from work, and her recent accident. She was given 6 points on her licence, and a £220 fine, she also recieved a bill from the local council of £280 for there time and effort in closing the road. ( The helicopter had to land on the carriageway), but she has been advised to pass this on to her insurance company. Lets hope this has a positive effect on her future driving,

Geoff, thats a fair outcome. She could have had a ban imposed. She just needs to learn from it and put it down to experience and move on.
If she's a stunner I'll give her personal driving lessons, one to one of course.  :whistling:

Rusty

Geoff .... that's a reasonable outcome. :agree:

Yes she is actually Steve, a real cracker with a figure any lady would be proud of, blonde hair, and the most lovely smile. Oh and she is single. Of course I shall mention your offer when I see her at work tomorrow.
