Title: Question for any boys in blue...
Post by: Andrew-MP on January 11, 2013, 06:37:06 PM
Does anyone know what the effect of a police caution plus 3 has, if any? My understanding is that it does not result in a criminal record and is simply a means of requesting someone to attend an interview at a police station and to give the interviewee their rights.  Am I right?

:help:

I just Googled it and got this, I don't know if this is what you are enquiring about, but it may help.

I know there are others on here who will be able to accurately answer

Thanks OC.  Yeah I saw that and so I think that it is not a 'real' Police Caution that would be disclosed in a CRB check or be damaging in the future??

I havn't interviewed anyone in a long long time but from my understanding a +3 is "come along to the nick for an interview and if you want free legal advice you can have it ( because you are at a Police Station ) .. Codes of Practice etc ... and you are free to leave at any time etc ... it should all be very friendly !

If you want any further advice pop in to your local nick .. if it hasn't been closed down and ask to speak to a detective .... if of course he or she hasn't been put back in uniform ... and I am sure they would be more than happy to help you ....

Hope this helps !

In order for any caution to be administered the offence has to be admitted.

It can then be used in any future proceedings if re-offending occurs.

It is an alternative to prosecution for first/minor offences.

Without an admission the police should proceed with a prosecution as there must be sufficient evidence to support a court case

To clarify 'cautions'

There are two different meanings to 'caution' in legal terms.

A Caution in respect of the initial question revolves around admissions and an alternative to prosecution.

A caution in the other term is the wording given when formally speaking to a suspect.

It's a requirement of law to warn an individual they don't have to speak to the police if they don't want to but if they don't a court may take inference that hey are keeping quiet not to drop themselves in it!

A further caution is given prior to charge.

So in a nutshell-

A verbal caution is given prior to interview/charge

A formal caution (and caution +) are a formal warning when an admission is given for a first /minor offence.  Caution + is part of the 'three strikes and out' for juvenile offenders

I can honestly say I've never heard of a caution + 3. I've heard of a book 3 interview but that's it. We lead sheltered lives out here in the sticks at Bradford it's that quiet here and virtually crime free.
