i ordered a rear hugger from what i thought was a reputable dealer,in black, ready to fit it i noticed a bad patch on the finish with a couple of indent's on it,i was gonna fit it,i had second thought's,after all it was at a cost to me at £95.i at 1st thought just fit it,& be done with it,it's the prinsaple at the end of the day, would you keep stum & simply fit the bl**dy thing & be done with it,i was undecided over what to do,after alot of thought i sent them an email stating i was not at all happy with the finish & that i'll be sending it back recorded post (to be signed for),would you have done the same or just fitted it & said nothing.NOT A HAPPY CHAPPY. :shit: :shit: :shit:
I'd have ataken it back..... in person :hammer: cos they must have known when they sent it that it was buggered, who was it btw??
they just sent me an email,STATING SEND IT BACK & WE WILL LOOK AT IT FOR YOU,taking the pi** come's to mind.they will indeed be getting it back,if no JOY I'LL CERTAINLY NAME & SHAME THEM,at the end of the day your spending you HARD URNED CASH on something you would expect it to arrive in good condition.RANT OVER
It sounds like their cock up, and its your right to tell them so...... but do so rationally, that approach often works better than the alternative (in my experience)
If they don't respond correctly then you can ball them out
If you paid by a credit card you may well have some come back through that route
Under the distance selling regulations you have 14 days to inspect and return even if the product is perfect. This is because in a shop you are deemed to have inspected the goods and accepted they are suitable or not. For goods (and services) bought on line or on the telephone, you cannot judge if they are suitable or not hence the cooling off period. Send it back and ask nicely for a refund. If they do not co-operate report them to your local Trading Standards, usually based at your Town Hall offices. Who is the seller by the way? Good luck.
Name and Shame ???? so no one else gets ripped off.
If you are paying hard earned cash you expect it to be right, simple as.
Unfortunately not all products can be QC'd before dispatch. As pointed out above you are entitled to a refund or exchange. Under the regulations you shouldn't have to pay for shipping a return.

I think under the aforementioned Distance Selling Regulations the buyer is responsible for the return postage (otherwise people would take the piss and order stuff to look at and expect the seller to pick up the postage both ways)

sounds right, if you were taking back to a shop , you would have your fuel costs , postage is just a similair expense in returning the item

Returning goods

Only if it is covered in the contract and the written information
can you require the consumer to pay for the cost of returning
the ordered goods. If the consumer then fails to return the
goods, or sends them at your expense, you can charge them
the direct cost to you of the return, even if you have already
refunded the consumer's money. You are not allowed to
make any further charges, such as a restocking charge or an
administration charge.
If you do not include these details in the required written
information then you cannot charge anything. You can never
require consumers to pay the cost of returning substitute
goods. If the goods are faulty or do not comply with the
contract, you will have to pay for their return whatever the
circumstances.
just an update on the rear hugger,i sent it back to the manufacturer & they are INDEED making me a REPLACEMENT,will be ready for shipping at the end of the week as they are made to order,i had a pyramid plastic's rear hugger on my xjr1300 & that was great quality,i have since seen one made for the GTR 1400 on fleabay, the other item i ordered about the same time is a headlight protector, that's just been shipped,i hope there's nothing wrong with that, one of the problem's with ordering online, you cant inspect it before you buy it.the rear hugger cost me £12 to return by post  there was no apologie for sending me one in a :shit: state.with a bit of luck the replacement one will be ok.
replacement sent,look's great,just a matter of fitting it.may make me :sweatdrop: a little,i hope it's an easy fit :mfr_lol:
well I would be wanting the return postage paid. they sent it out in that condition, so why should you pay for their mistake.
i feel shamed for the dealer. he just lost a faithful friend and custom. if i were in your position, i will do any thing i can to protect my right.
